The Chair of the NYS Cannabis Control Board, Tremaine Wright, recently announced that she does not anticipate the state to begin issuing licenses until Spring of 2023. For those who have seriously considered getting involved in the legal business of cannabis, licensing has been one of the recurring concerns.
At the core of conversations around the business of cannabis, the topic of licenses constantly arises. Licensing dictates which businesses are legal and considered legitimate, and which businesses have the potential of being targeted more heavily by law enforcement. It determines who can operate where, what products they can sell, and what types of cannabis related business or production people can engage in. The process to obtain licenses in other states has shown to be challenging in many cases. Large application and licensing fees, strict regulations, large capital requirements, location requirements, and compliance with multiple government regulatory agencies can create all kinds of challenges for those who hope to get their hands on a license or keep one.
According to the National Cannabis Industry Association, dispensaries, one of the most desired cannabis businesses, can have startup costs ranging between $250,000 and $750,000. Fortunately, in New York, we have 11 different licenses to choose from. We are not limited to dispensaries. While there will still be various fees, there are multiple pathways into the industry for us to explore. Whether your interest is a dispensary or something else, join us as we discuss the licenses under the MRTA and what it can take to qualify for a license.

As a senior associate in the cannabis group of Foley Hoag @foleyhoag, LLP, Cecilia Oyediran @thcee_esq advises clients on licensing, regulatory, and compliance matters in the legal cannabis industry. Cecilia currently serves as a member of the New York State Bar Association Committee on Cannabis. Additionally, Cecilia is also a member of the Minority Cannabis Business Association (MCBA) and participated in the MCBA’s 2021 Annual State Policy Summit. A passionate advocate for cannabis education, Cecilia is a frequent speaker and panelist on a range of issues related to state cannabis licensing, social equity, and corporate law, and volunteers her time to mentor students and young professionals interested in entering the cannabis industry. Cecilia holds a Bachelor of Arts degree from Yale University, a Master’s in Education from Harvard University, and a law degree from Stanford Law School.
Brittany Carbone
Brittany Carbone founded TONIC @tonic_cbd in 2017, while working as a personal trainer and health coach on Long Island, NY. Bootstrapping as a solopreneur, Carbone grew the company from a side-hustle operating out of her parents’ kitchen to the 7-figure business it is today, all while staying true to her original vision and mission of bringing the most healing to the most people. Brittany not only leads the all-female team at TONIC as the Founder & CEO, but she also co-founded Tricolla Farms @tricollafarms and Bardo Labs @bardo.labs. Brittany has hands-on experience in every aspect of CBD brand development and management. From manufacturing, marketing, and sales to regulatory compliance and industry insights, Brittany is able to provide Bardo and its clients with tactical guidance to navigate a complicated and rapidly-changing space.
Steven Phan
New York City-based entrepreneur Steven Phan @phan_man has been an activist in the cannabis space for over a decade, where he also spent time working for a CBD company and noticed a need for peer-to-peer interaction. In 2018, he opened Come Back Daily @comebackdaily, an experiential CBD retail store in Tribeca. Using a hands-on approach supported by knowledgeable staff, customers are encouraged to sample CBD products and learn about how cannabis can benefit their lifestyle. Since then, Come Back Daily has opened two more locations in Manhattan and Phan has continued to play an active role as a leader in the community. His opinions on industry topics and issues such as hemp legalization, the FDA’s crackdown on CBD, and earning support to legalize cannabis from legislators of color have been published media outlets that includes Crains NY, Gotham Gazette, Business Insider, the Daily Marijuana Observer, Marijuana Business Magazine among others.
Alana Hans-Cohen
Alana Hans-Cohen is a licensed attorney in New York, New Jersey, Massachusetts, Washington State, Colorado, and Illinois. Alana is a self-proclaimed “cannabis nerd,” who focuses on cannabis law and policy. Alana’s true passion lies in advocating for social equity in the cannabis industry, and her professional and personal philosophy includes giving back in ways that make a meaningful difference to the local and global communities to which she dedicates her practice. She is a firm believer in the idea of an equitable and diverse legal and regulated cannabis industry.
Lanese Martin
Lanese Martin @nesenotsonice is an award-winning community organizer with a background in electoral campaigns, policy and advocacy on issues impacting Black people and the areas they work, live & play - Lanese supports projects that address systemic inequality. As co-Founder of The Hood Incubator @hoodincubator, which is a national grassroots organization, she guides the organization’s mission to end the drug war and reverse its impacts on Black communities. Lanese spearheads the organization's political strategy and workforce development. In less than 5 years she has grown the organization to be the leading voice in its space. Lanese also Chairs the City of Oakland’s Cannabis Regulatory Commission. Under Lanese's leadership the city of Oakland has the most comprehensive equity program to date in the country.
